The volume gathers theoretical contributions on human rights and global justice in the context of international migration. It addresses the need to reconsider human rights and the theories of justice in connection with the transformation of the social frames of reference that international migrations foster. Background Consent policies for post-mortem organ procurement (OP) vary throughout Europe, and yet no studies have empirically evaluated the ethical implications of contrasting consent models. To fill this gap, we introduce a novel indicator of governance quality based on the ideal of informed support, and examine national differences on this measure through a quantitative survey of OP policy informedness and preferences in seven European countries. -/- Methods Between 2017–2019, we conducted a convenience sample survey of students (n = 2006) in (...) Austria (AT), Belgium (BE), Denmark (DK), Germany (DE), Greece (GR), Slovenia (SI) and Spain (ES), asking participants about their donation preferences, as well as their beliefs and views about the policy in place. From these measures, we computed indices of informedness, policy support, and fulfilment of unexpressed preferences, which we compared across countries and consent systems. -/- Results Our study introduces a tool for analyzing policy governance in the context of OP. Wide variation in policy awareness was observed: Most respondents in DK, DE, AT and BE correctly identified the policy in place, while those in SI, GR and ES did not. Respondents in opt-out countries (AT, BE, ES and GR) tended to support the policy in place (with one exception, i.e., SI), whereas those in opt-in countries (DE and DK) overwhelmingly opposed it. These results reveal stark differences in governance quality across countries and consent policies: We found a preponderance of informed opposition in opt-in countries and a general tendency towards support–either informed or uninformed–in opt-out countries. We also found informed divergence in opt-in countries and a tendency for convergence–either informed or uninformed–among opt-out countries. -/- Conclusion Our study offers a novel tool for analyzing governance quality and illustrates, in the context of OP, how the strengths and weaknesses of different policy implementations can be estimated and compared using quantitative survey data. En la primera parte se muestran las diferentes aristas de la cuestión de la religión, poniendo énfasis en los aspectos filosófico-políticos, sobre todo el que concierne a la “traducción” del lenguaje religioso al secular como un “requisito” de acceso a la esfera pública. En la segunda parte, se reconstruye, señalando sus límites o dificultades, el concepto de “traducción” en Habermas. The learning process of both students and teachers can be predicted based on the learning mode. Therefore, because of the COVID-19 pandemic, schools must start using online learning and abandon more traditional teaching techniques. Thus, this study investigates the relationship between self-efficacy and academic resilience among 150 senior high school students. Thus, the researchers employed General Self-Efficacy and Resilience Scale. Finally, the statistical analysis reveals that the r coefficient of 0.78 indicates a high positive correlation between the variables. The p-value (...) of 0.00, which is less than 0.05, leads to the decision to reject the null hypothesis. Hence, a significant relationship exists between self-efficacy and resilience among senior high school students. (shrink)

En la literatura sobre las emociones una de las teorías con mayor fuerza es la llamada “teoría James-Lange”. En esta obra se intenta hacer una crítica a dicha teoría a partir de algunas observaciones de Wittgenstein sobre el uso de conceptos psicológicos, sacando a la luz dos confusiones gramaticales que surgen en ella. Para ello, se construye primero la categoría de “programa de naturalización de las emociones” que recoge las teorías del Descartes, James y Prinz, siguiendo la metodología de Lakatos. (...) Luego, se identifica como problema central el de la naturalización de la intencionalidad. Para luego exponer algunas herramientas de Wittgenstein para estudiar la gramática de la pregunta por el objeto y la intencionalidad las emociones, mostrando que las respuestas del programa de naturalización no son satisfactorias y no respetan las reglas de ciertos usos del lenguaje. La presente investigación se propone mostrar la génesis y desarrollo de la tentativa matriz de la filosofía de Gilles Deleuze, el empirismo trascendental. Para ello, se realizará una revisión de las problemáticas por las que atraviesa dicha tentativa a lo largo de la obra de este pensador. Cuidadosa atención recibirán a propósito de la génesis del empirismo trascendental el problema del hábito y el de la constitución de la subjetividad, que Deleuze reconoce en Hume (Empirisme et subjectivité, 1953). A partir (...) de ellos, se establecerán los caracteres principales del que se identifica como problema de los principios, en cuyo seno se define una relación particular entre principio y génesis. Gracias al establecimiento riguroso de dicha relación, Deleuze integra los aportes del empirismo y los de la filosofía trascendental bajo una misma propuesta filosófica. Esta propuesta tendrá a la vista el desarrollo de una crítica sistemática hacia lo dado, con lo cual tanto el objeto como el sujeto del pensar precisarán ser sometidos a una indagación acerca de su génesis. Definido el empirismo trascendental como la tentativa filosófica que apunta a pensar la génesis trascendental o actualización de lo dado, esta investigación espera dar cuenta del ámbito de dicha génesis así como de los principios de determinación que la rigen. Para ello se estudiarán las nociones de campo trascendental, plan de inmanencia y continuo ideal (Différence et répétition, 1968; Logique du sens, 1969). Al abordar esta última noción, se pondrá especial interés en dilucidar la reformulación que efectúa Deleuze de los princip ios de razón suficiente, de indiscernibilidad y de continuidad de Leibniz (Le Pli, 1988). Gilles Deleuze’s research during the 1980s focused on the 17th century German thinker G. W. Leibniz. In 1988, Deleuze published Le Pli, which forms part of a series of works on modern philosophy. This book displays Deleuze’s attention to the interpretations of contemporary commentators on modern philosophy, in this case, on Leibniz. In this context, there occurred a brief and important dialogue between Deleuze and Christiane Frémont, the French commentator and translator of Leibniz, with regard to their respective interpretations of (...) the great German philosopher. This article intends to give an account of the main topics present in that conversation. Firstly, we can say they involve 1) the problem of body and the Leibnizian vinculum substantiale, 2) the question of singularities, 3) the principle of economy and incompossibility, and 4) the Deleuzian concept of vice-diction. Our hypothesis in this study is that the readings made by both authors of the German thinker are mutually involved. It is essential, in order to support this hypothesis, to make precise the demarcations of relations between such readings. For this reason, our research will focus on Frémont’s study Singularités, individus et relations dans le système de Leibniz (2003) and on Deleuze’s work Le Pli (1988). We hope to determine the topics that emerge in the relationship, and to specify convergences and divergences of interpretation. (shrink)

This chapter introduces and discusses the concepts that are in-depth articulated in the volume. International migration is presented here as a test bench where the normative limits of institutional order, its contradictions and internal tensions are examined. Migrations allows to call into question classical political categories and models. Pointing at walls and fences as tools that reproduce enormous inequalities within the globalized neo-liberal system, this chapter presents the conceptual tensions and contradictions between migration policies and global justice. We challenge the (...) conceptualization of justice as a relationship between citizens of the same country and the State and argue that, in our globalized world, nation-state cannot constitute the basic unit of the theories of justice. We argue that an integral approach that includes the complex and interconnected forms of structural inequalities and transcends the borders of national sovereign states is required. Avoiding the methodological nationalism and the exclusionary biases that inform current migration and border control policies, this chapter finally places attention on the most marginalized subjects of the migration chain: migrant women workers. We point out the importance of addressing transnational structural inequalities and bringing social reproduction to the center of global justice theories. (shrink)

In this issue of the Report, James L. Bernat proposes an innovative and sophisticated distinction to justify the introduction of permanent cessation as a valid substitute standard for irreversible cessation in death determination. He differentiates two approaches to conceptualizing and determining death: the biological concept and the prevailing medical practice standard. While irreversibility is required by the biological concept, the weaker criterion of permanence, he claims, has always sufficed in the accepted standard medical practice to declare death. Bernat argues that (...) the medical practice standard may be acceptable on the ground that proving circulatory or brain permanence is sufficient to assure complete accuracy for death diagnosis. -/- The topic requires public deliberation: processes to survey people's opinions and mechanisms to channel their opinions into policy-making. RESUMENEl presente trabajo tiene por objetivo reconstruir sistemáticamente la “hermenéutica trascendental” de Karl-Otto Apel. En primer lugar, se describe el desarrollo de la interpretación apeliana de Heidegger, la cual consideramos que puede ser dividida en cuatro momentos. En segundo lugar, se explican los principales puntos de disenso de Apel con la hermenéutica filosófica de Gadamer. A lo largo del trabajo sugerimos, además, posibles caminos teóricos abiertos para la hermenéutica trascendental en tanto programa filosófico de investigación. ABSTRACTThis paper aims to systematically (...) reconstruct "transcendental hermeneutics" of Karl-Otto Apel. Firstly, we describe the development of Heidegger's apelian interpretation, which we consider can be divided into four stages. This paper presents some annotations on mental health, from the point of view of implicit notions of madness. To this end, we propose a distinction between the medical, phenomenological existential and socio-critical models. We focus in the latter two in order to achieve a critical approach about the subject, dominated by the medical perspective. According to Foucault's earliest works, this article begins by evaluating criteria of normality in terms of the historical genesis of madness concept. Then, we describe the medical (...) model based on the distinction between illness and symptom. Later, we focus on the phenomenological-existential model to describe the ontological fragility in Laing, i.e. the original core of the self and the world experienced by the schizophrenic person. Finally, we add some considerations related to the social origin of schizophrenia, as stated in the Cooper's and Foucault's perspectives. (shrink)

Since 1968, the irreversible loss of functioning of the whole brain, called brain death, is assimilated to individual’s death. The almost universal acceptance of this neurological criterion of death had decisive consequences for the contemporary medicine, such as the withdrawal of mechanical ventilation in these patients and organ retrieval for transplantation. The new criterion was successfully accepted in part because the assimilation of brain death state to death was presented by medicine --and acritically assumed by most of societies-- as a (...) scientific and objective fact. Nevertheless, many people do not think that the patients suffering brain death are actually dead. We show here that those people are not necessarily wrong. It can be argued that, in fact, the justification of the neurological criterion is not scientific but moral. We outline the thesis that the problem surrounding the vital status of brain dead patients is due to a confusion between factual and normative questions. Furthermore, we claim that the donation of organs and the withdrawal of life-support could be ethically acceptable even if the patients suffering brain death are considered as alive. As an alternative to the dead donor rule, we propose a justification for organ donation of brain-dead patients based on the (moral) concepts of harm and consent : what truly justifies the procurement of organs on those patients is not that they are dead, but that they wish to donate their organs and that, since they have irreversibly lost their brain, they cannot be harmed. Alireza Bagheri supports a policy on organ procurement where individuals could choose their own definition of death between two or more socially accepted alternatives. First, we claim that such a policy, without any criterion to distinguish accepted from acceptable definitions, easily leads to the slippery slope that Bagheri tries to avoid. Second, we suggest that a public discussion about the circumstances under which the dead donor rule could be violated is more productive of social trust than constantly moving the line (...) between life and death. According to resemblance nominalism, things have their properties in virtue of resembling other things. This unfashionable view is championed with clarity and rigor.

Despite the distance between the philosophies of Merleau-Ponty and of Deleuze, it is possible to discover not only analogue complicity with regard to thecriticism addressed to Husserl. In the aesthetic, for example, we note that the last thoughtsof Merleau-Ponty, present mainly in The visible and the invisible, are a constant referencefor the works that Deleuze dedicates to the painter Francis Bacon. In the present researchwe expect to define the passages on account of the reading of Husserl, and to show thepoint (...) of contact between Merleau-Ponty and Deleuze. El presente trabajo se propone señalar algunas tareas posibles para la ética del discurso de Karl-Otto Apel en la actualidad. Tales tareas pueden concentrarse en la necesidad de una teoría de la institucionalización del discurso práctico, como forma de racionalidad práctica realizada socialmente. La pregunta que se ha de responder es qué condiciones marco debe cumplir el discurso para que pueda ser puesto en práctica y qué efectos político-institucionales puede producir en el contexto de instituciones realmente existentes. A partir de (...) Gehlen y de Luhmann -aunque en menor medida-, Apel interpreta a las instituciones como sistemas de autoafirmación que, por un lado, liberan a los sujetos de la carga de la acción, pero, por otro lado, limitan o condicionan la racionalidad práctica consensual-argumentativa propia del discurso. Las coerciones (Sachzwänge) funcionales de las instituciones configuran un campo de acción y un tipo de racionalidad que, de acuerdo con Apel, deberían estar bajo el control del discurso institucionalizado como esfera pública racional (Öffentlichkeit). La relación entre los criterios normativos ideales del discurso práctico institucionalizado y las instituciones realmente existentes debe interpretarse como una tensión o entrelazamiento dialéctico no superable. Si esta interpretación es correcta, la ética del discurso, en tanto teoría crítica de la sociedad, no puede ser entendida como una aplicación sin más de criterios normativos ideales a la realidad histórica o de adecuación de esa realidad a los criterios ideales en su sentido vertical, sino como de mutua correlación horizontal. Gardeners, poets, lovers, and philosophers are all interested in the redness of roses; but only philosophers wonder how it is that two different roses can share the same property. Are red things red because they resemble each other? Or do they resemble each other because they are red? Since the 1970s philosophers have tended to favour the latter view, and held that a satisfactory account of properties must involve the postulation of either universals or tropes. But Gonzalo Rodriguez-Pereyra revives (...) the dormant alternative theory of resemblance nominalism, showing first that it can withstand the attacks of such eminent opponents as Goodman and Armstrong, and then that there are reasons to prefer it to its rival theories. The clarity and rigour of his arguments will challenge metaphysicians to rethink their views on properties. (shrink)

The point of the Bundle Theory is to avoid undesirable entities like substrata that allegedly constitute particulars. The version of the Bundle Theory I shall discuss takes particulars to be entirely constituted by the universals they instantiate.' Thus particulars are said to be just bundles of universals. Together with the claim that it is necessary that (...) particulars have constituents, the fundamental claim of the Bundle Theory is: (BT) Necessarily, for every particular x and every entity y, y constitutes x if and only ify is a universal and x instantiates y. 2 The standard and supposedly devastating objection to the Bundle Theory is that it entails or is committed to a false version of the Principle of Identity of Indiscernibles (Armstrong 1978: 91, Loux 1998: 107), namely: (Pll) Necessarily, for all particulars x and y and every universal z, if z is instantiated by x if and only if z is instantiated byy, then x is numerically identical with y. The most famous counterexample to the Identity of Indiscernibles is that put forward by Max Black, consisting of a world where there are only two iron spheres two miles apart from each other, having the same diameter, temperature, colour, shape, size, etc (Black 1952: 156). Let us from now on think of the properties of the spheres in this world as universals. The possibility of this world, which I shall hereafter refer to as 'Black's world', makes (Pll) false.' And according to common philosophical opinion this means that the Bundle Theory is false.. (shrink)

The suppression of trade barriers and liberalization of financial flows inherent to the expansive dynamic of globalization have not extended to international flows of workers. To impede the free movement of workers, restrictive migratory policies have been implemented, and borders have been fortified with walls and fences. In the face of this widespread phenomenon, this chapter presents an alternative consisting of three steps. First, it is noted that in the current migratory context, borders play a key role in reproducing inequalities (...) between countries. Next, it is argued that given the incompatibility of this function with global justice, it is necessary to seek some remedy to put an end to the suffering caused by this structural injustice, a suffering that is endured by an immense number of people unlucky enough to have been born on the wrong side of a border. After presenting a conception of borders that, unlike walls, would enable the movements of people, finally, a scenario is proposed in which the rights of political membership would be reassigned in a cosmopolitan manner and in which borders would usually remain open. Although this does not entail a radical suppression of the aforementioned injustice, its implementation would contribute to not only its reduction but also to the compensation of victims. (shrink)

We undertook a systematic review to determine public knowledge and attitudes towards these models in Europe. Methods: Six databases were explored between 1 January 2008 and 15 December 2017. We selected empirical studies addressing either knowledge or attitudes towards the systems of consent for deceased organ donation by lay people in Europe, including students. Study selection, data extraction, and quality assessment were conducted by (...) two or more reviewers independently. Findings: Awareness of the consent model was lower in opt-out countries than in opt-in countries. A majority of the public agrees with opt-in, regardless of the law in their own country. There are ambivalent attitudes regarding the opt-out system. The public tend to prefer opt-in and mandatory choice over opt-out when several options are offered. Interpretation: The assumption that people in opt-out countries are aware of the legal requirements to be excluded from the pool of potential donors is not supported by the results of this review. This is a concern, since ignorance hinders people's autonomy regarding organ donation decision-making. Higher awareness of consent model in opt-in countries may reflect greater efforts to inform the public through campaigns to motivate donation. Legal moves towards opt-out are at odds with people's expressed preferences. Main limitations of this review are the lack of data from some countries, study population heterogeneity, and methodological shortcomings. (shrink)

The Razor says: do not multiply entities without necessity! The Laser says: do not multiply fundamental entities without necessity! Behind the Laser lies a deep insight. This is a distinction between the costs and the commitments of a theory. According to the Razor, every commitment is a cost. Not so according to the Laser. According to the Laser, derivative entities are an ontological free lunch: that is, they are a commitment without a cost. Jonathan Schaffer (2015) has argued that the (...) Laser should replace the Razor. In Sections 2-4 we shall discuss and argue against Schaffer’s arguments for replacing the Razor with the Laser. Schaffer considers several objections to his views, and in Sections 5-7 we shall argue that Schaffer does not deal successfully with two of them. In Section 8 we shall present a probabilistic argument for the Laser. However, the argument has a limitation and does not support the replacement of the Razor with the Laser. Indeed, it supports only the claim that, given certain assumptions, the multiplication of explanatorily relevant derivative entities does not matter; but, as we argue in the same section, there is an argument that multiplying explanatorily superfluous derivative entities does makes a theory less rationally acceptable. Our conclusion is that the Laser cannot replace the Razor and that derivative entities are not an ontological free lunch. (shrink)

Les débats éthiques sur l’architecture ont traditionnellement abordé trois thématiques récurrentes : la beauté, la solidité et l’utilité de l’œuvre architecturale. Plus récemment, les nouvelles connaissances provenant du domaine de la gestion des projets et du développement durable ont apporté d’importantes contributions à la compréhension de la gouvernance de projets. Cependant, la démarche de réalisation des projets d’architecture est tributaire des caractéristiques propres à l’industrie du bâtiment; une industrie qui fonctionne grâce à la mise en place d’équipes temporaires formées par (...) des organisations hautement spécialisées. L’analyse systémique d’études de cas permet d’identifier la complexité des équipes qui interviennent dans les projets d’architecture. Nous examinons dans cet article trois caractéristiques de l’industrie du bâtiment : (i) la com- plexité organisationnelle du donneur d’ouvrage, (ii) l’influence des parties prenantes, et (iii) les divers niveaux de proximité entre l’architecte et les usagers. L’identification des diverses configurations organisationnelles met en évidence les effets de ces caractéristiques sur les relations formelles et informelles entre l’architecte et les donneurs d’ouvrage ainsi que celles entre toutes les parties prenantes. L’architecte est contraint de travailler sur un projet qui devient, de plus en plus, l’objet de négociation entre les diverses parties prenantes. Face à ce défi, il doit tenir compte de la complexité des relations entre tous les acteurs au sein du système social du projet et créer les scénarios adéquats à la participation, à la négociation et aux échanges entre eux. In this note we shall argue that Milne’s new effort does not refute Truthmaker Maximalism. According to Truthmaker Maximalism, every truth has a truthmaker. Milne has attempted to refute it using the following self-referential sentence M: This sentence has no truthmaker. Essential to his refutation is that M is like the Gödel sentence and unlike the Liar, and one way in which Milne supports this assimilation is through the claim that his proof is essentially object-level and not semantic. In Section (...) 2, we shall argue that Milne is still begging the question against Truthmaker Maximalism. In Section 3, we shall argue that even assimilating M to the Liar does not force the truthmaker maximalist to maintain the ‘dull option’ that M does not express a proposition. There are other options open and, though they imply revising the logic in Milne’s reasoning, this is not one of the possible revisions he considers. In Section 4, we shall suggest that Milne’s proof requires an implicit appeal to semantic principles and notions. In Section 5, we shall point out that there are two important dissimilarities between M and the Gödel sentence. Section 6 is a brief summary and conclusion. (shrink)

According to one of Leibniz's theories of contingency a proposition is contingent if and only if it cannot be proved in a finite number of steps. It has been argued that this faces the Problem of Lucky Proof , namely that we could begin by analysing the concept ‘Peter’ by saying that ‘Peter is a denier of Christ and …’, thereby having proved the proposition ‘Peter denies Christ’ in a finite number of steps. It also faces a more general but (...) related problem that we dub the Problem of Guaranteed Proof . We argue that Leibniz has an answer to these problems since for him one has not proved that ‘Peter denies Christ’ unless one has also proved that ‘Peter’ is a consistent concept, an impossible task since it requires the full decomposition of the infinite concept ‘Peter’. We defend this view from objections found in the literature and maintain that for Leibniz all truths about created individual beings are contingent. (shrink)

Consider a certain red rose. The proposition that the rose is red is true because the rose is red. One might say as well that the proposition that the rose is red is made true by the rose’s being red. This, it has been thought, does not commit one to a truthmaker of the proposition that the rose is red. For there is no entity that makes the proposition true. What makes it true is how the rose is, and how (...) the rose is is not an entity over and above the rose. It is against this view that I shall argue in this paper. I shall argue that a significant class of true propositions, including inessential predications like the proposition that the rose is red, are made true by entities. "No truthmaking without truthmakers" is my slogan. Although I have my view about what kinds of entities are truthmakers, I shall not argue for or presuppose that view here. All I shall argue for here is that if a proposition is made true by something, it is made true by some thing, but my argument will leave it open what kind of thing that thing is: it could be a fact or state of affairs, a trope, or any other sort of entity. Objectives To increase postmortem organ donation rates, several countries are adopting an opt-out (presumed consent) policy, meaning that individuals are deemed donors unless they expressly refused so. Although opt-out countries tend to have higher donation rates, there is no conclusive evidence that this is caused by the policy itself. The main objective of this study is to better assess the direct impact of consent policy defaults per se on deceased organ recovery rates when considering the role of the family in (...) the decision-making process. This study does not take into account any indirect effects of defaults, such as potential psychological and behavioural effects on individuals and their relatives. -/- Design Based on previous work regarding consent policies, we created a conceptual model of the decision-making process for deceased organ recovery that included any scenario that could be directly influenced by opt-in or opt-out policies. We then applied this model to internationally published data of the consent process to determine how frequently policy defaults could apply. -/- Main outcome measures We measure the direct impact that opt-in and opt-out policies have per se on deceased organ recovery. -/- Results Our analysis shows that opt-in and opt-out have strictly identical outcomes in eight out of nine situations. They only differ when neither the deceased nor the family have expressed a preference and defaults therefore apply. The direct impact of consent policy defaults is typically circumscribed to a range of 0%–5% of all opportunities for organ recovery. Our study also shows that the intervention of the family improves organ retrieval under opt-in but hinders it under opt-out. -/- Conclusions This study may warn policy makers that, by emphasising the need to introduce presumed consent to increase organ recovery rates, they might be overestimating the influence of the default and underestimating the power granted to families. This bulletin contains a summary of the main topics of discussion in truthmaker theory, namely: the definition of truthmakers, problems with Truthmaker Necessitarianism and Truthmaker Maximalism, the ontological burden of truthmakers and the recalcitrant topic of truthmakers for negative truths.

This note argues that research in analytical philosophy broadly conceived should be published exclusively in English. Reasons are given for this and the thesis is defended against thirteen objections.

Peter Milne has tried to refure Truthmaker Maximalism. the thesis that every truth has a truthmaker, by producing a simple and direct counterexample to it, the sentence M: This sentence has no truthmaker. I argue that, contrary to what Milne argues, on Truthmaker Maximalism M is equivalent to the Liar, which gives the truthmaker maximalist a way to defend his position from Milne's counterexample: to argue that M expresses no proposition.

In this dissertation, I address the question of how to construct scientific theories of emotions that are both conceptually sound and empirically fruitful. To do this, I offer an analysis of the main challenges scientific theories of emotions face, and I propose a meta-theoretical framework to construct scientific concepts of emotions as explications of folk emotion concepts. Part I discusses the main challenges theories of emotions in psychology and neuroscience encounter. The first states that a proper scientific theory of emotions (...) must explain all and only the phenomena under the vernacular term ‘emotion’ with a common set of conceptual resources and under an overarching generic concept of emotion. The second demands that each emotion category corresponds to well-coordinated sets of neural, physiological, and behavioral patterns of responses. I argue that none of the best contemporary theories of emotions in psychology and neuroscience overcomes these challenges. As a result, a new theory of emotions is required. In Part II, I develop the meta-theoretical framework to construct a theory of emotions that overcomes the challenges above. First, I propose a pluralistic account of scientific kinds based on different patterns of projection that various disciplines may take to justify inductive inferences. These are essentialist, historical, and social patterns. Each of these patterns provides a framework to construct different types of scientific concepts. I argue that among the frameworks for scientific kinds available, the one that is best suited to explicate emotion concepts is a functional framework. Consequently, I conclude by recommending scientists pursue functionalist theories of emotions over essentialist, historical, or social theories. (shrink)

This paper analyses the arguments for and against what we have called automatic organ procurement model in relation to the organs of the deceased. For this purpose, this work provides empirical evidence to assess the potential impact of this model on donation rates and on public opinion. Specifically, we examine first the reasons supporting this model, with special reference to utilitarian and justice arguments. On the other hand, we analyse both the approaches based on the violation of pre mortem and (...) post mortem interests opposing this theoretical model and the rejection the model would generate in the population. Finally, we point out the aspects that, in our opinion, should be exhaustively regulated if this model were implemented. In particular, we refer to the legal status of the human body, the treatments for end-of-life patients, the incentives for health professionals and the recognition of the right to conscientious objection. In the Discourse on Metaphysics Leibniz put forward his famous complete-concept definition of substance. Sometimes this definition is glossed as stating that a substance is an entity with a concept so complete that it contains all its predicates, and it is thought that it follows directly from Leibniz’s theory of truth. Now, an adequate definition of substance should not apply to accidents. But, as I shall point out, if Leibniz’s theory of truth is correct then an accident is an entity (...) with a concept so complete that it contains all its predicates. The aim of this paper is to clarify Leibniz’s notion of substance in the Discourse with a view to explaining how that definition successfully distinguishes between substances and accidents. (shrink)

Descartes maintained substance dualism, the thesis that no substance has both mental and material properties. His main argument for this thesis, the so-called separability argument from the Sixth Meditation (AT VII: 78) has long puzzled readers. In this paper I argue that Descartes’ independence conception of substance (which Descartes presents in article 51 of the Principles) is crucial for the success of the separability argument and that Descartes used this conception of substance to defend his argument for substance dualism from (...) an important objection.
